Government employees – that means paid workers for county, town and village governments and fire districts – have historically been prohibited from collecting LOSAP points for benefits performed during their normal working hours.
Section 217(f) of the New York General Municipal Law provides “In computing credit for those active volunteer firefighters who also serve as paid employees within a political subdivision of the state, credit shall not be given for activities performed during the individual’s regularly assigned work periods.”
Good news for government workers and fire departments with LOSAP programs seek to incentivize response with LOSAP point: Section 217(f) of the GML was repealed effective December 11, 2015 (Laws of 2015, Chapter 534). Government workers are now permitted to receive credit for fire department activities performed during their regularly assigned work periods as of repeal of Section 217(f) on December 11, 2015.
It should be noted that the repeal was only for volunteer firefighters. Volunteers in the emergency medical services are still prohibited from receiving LOSAP points during their assigned work periods pursuant to Sections 219(e)(6) and 219(m)(6).
